Conditions of Entry - Anthony Tesselaar Promotion

1. Information on "how to enter" and prizes form part of conditions of entry.

2. Enter as many times as you wish, by telling us in 25-words-or-less why you feel you deserve to win a luxury weekend away to the Melbourne Flower Show in Your Garden Magazine cover dated 14/11/07.

Each written entry must be on an original entry form and mailed to PO Box 136 Eastern Suburbs MC NSW 2004

3. Entry is open to all residents of Australia except employees and immediate families of the Promoter, associated companies and agencies. The Promoter is Pacific Magazines Pty Ltd, 35-51 Mitchell Street, McMahons Point, NSW, 2060 (ABN 16 097 410 896).

4. The competition commences on 14/11/07 and closes on 09/01/08 last mail received. The winner will be the best entry selected by the judging panel, having regard to originality and creativity, at the Promoter's premises on 14/01/08 at 11am.

5. Total prize value is $4270, as at 16/10/07 and includes 2 return flights to Melbourne you're your nearest capital city inc. limo transfers valued at $1950, 3 nights accommodation at the Sofitel Melbourne including daily breakfast and one dinner for two valued at $1940, 2 x 2 day entry tickets to the Melbourne International flower and garden show valued at $80 and Anthony Tesselaar Plants valued at $300. Prize does not include spending money or extra meals not included in the terms above. 

6. Passports, visas, meals, spending money, transport to and from departure and arrival points and all other ancillary costs are winner's responsibility unless otherwise stated. Holidays are subject to flight and booking availabilities. Winners under the age of 18 must be accompanied by an adult on the trip. Prize must be taken between 02/04/08 and 06/04/08. In the event a winner does not take the prize by the time stipulated, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of prize. By entering the competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The winner, for themselves and their executors, releases the Promoter, its agents, officers and employees, from any and all legal claims in connection with any death, injury, incapacity, damage to property or other losses arising from or connected with the collection or enjoyment of the prize. Where the prize involves driving or travel, all winners under 18 years old must be accompanied by their legal guardian at all times. Before being eligible to collect a prize, each winner must provide to the Promoter proof of age, and if the winner is under 18 years old, the full name, address and telephone number of the winner's legal guardian. Before a winner is eligible to collect a prize, the guardian will be required to sign a release, in terms of the release given by the winner above. The release will also require the winner's guardian to accept responsibility for the acts and forbearances of the winner. Failure to provide such proof, particulars or releases will immediately invalidate the winner's entitlement to the prize, subject to state legislation.

7. Airport taxes and government levies may have to be paid at the time of booking which is at the expense of the winner.

8. Air Tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline on the travel prize and the winners and their travelling companions cannot upgrade any travel prize using Frequent Flyer points. Once airfares are booked and confirmed prize winners cannot make changes.

9. The judges' decision in relation to any aspect of the competition is final and binding on each person who enters. Chance plays no part in determining the winner. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner's nominated address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.

10. The winner will be notified by mail and all winners' names will be published in Your Garden magazine on the 12/03/08

11. The Promoter collects entrants' personal information in order to conduct the promotion and notify winners. If the information requested is not provided, the entrant may not participate in the promotion.

12. Entrants' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under the relevant lottery legislation. 13. In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners (and their companions) will not be entitled to any fee for such use.

14. The Promoter shall not be liable for any loss or damage whatsoever suffered, including but not limited to direct or consequential loss, or personal injury suffered or sustained during the course of prize winning trips or in connection with the redemption of and/or use of any other prizes. Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.
